Service Charge vs Tip in India: Your Legal Rights
Restaurants often add 5-10% service charge. You can legally refuse to pay it. Here are your rights and what the CCPA says.

In July 2022, the Central Consumer Protection Authority (CCPA) directed restaurants to: (1) Not add service charge automatically to the bill. (2) Not force or pressure customers to pay service charge. (3) Not deny service to customers who refuse to pay service charge. Despite this, many restaurants continue adding 5-10% service charge. You have the legal right to ask for its removal.
2.Service charge vs GST: the difference
GST (5% or 18% depending on restaurant type) is a government tax — you must pay it. Service charge is a discretionary charge by the restaurant — it is NOT a tax. Service charge is NOT guaranteed to reach the service staff (some restaurants keep part or all of it). A direct tip in cash to your server is more likely to reach them. If the bill says "service charge", ask the manager to remove it and tip your server directly instead.
3.How to handle it politely
Simply tell the server or manager: "Please remove the service charge from the bill. I'll tip directly." Most restaurants comply without argument. If they refuse, reference the CCPA guideline and mention the National Consumer Helpline (1800-11-4000). Take a photo of the bill as evidence. Practically, few customers contest — but knowing your rights matters.
